Answer #1
1. Tenancy by the entirety---Joint ownership only between husband and wife--
confers the right of survivorship over the property by which neither of the two can terminate without the consent of the other--which can be mutual, divorce or specific conveyance to the effect , to some third party.
2. Joint Tenancy--because of the following features that distinguishes, the joint tenancy from tenancy in common:
Unilaterally severing the tenanacy is not possible under tenanacy in common.
Tenancy in common, does not confer the automatic right of survivorship , to the other joint owners.
under which--unless there is a will of the deceased to the effect, his share belongs to the estate.
3..Tenancy in common-- where one can bequeath his share , by a written will, to whomsoever he desires--ie. The co-tenants do not have any devolving right on their own(right of survivorship) , to receive any of the decedent's share.
4.Community property--property acquired during marriage, by either or both spouses, while living as a community.
There is no right of survivorship & each spouse can will his/her 50% to whomsoever he/she desires.
Under the right of survivorship, the decedent's financial interest is SUBJECT TO the financial claims of the decedent's creditors, heirs or personal representatives.
So, the following forms
Tenancy by the entirety &
Joint tenancy
are subject to the right of survivorship.
