nitric acid accepts a proton from sulfuric acid and dissociates to form nitronium ion (NO2+) this nitronium ion acts as electrophile and nitrates the benzene ring.

tertiary alcohols can not be oxidized by strong oxidizing agents because there is no C-H bond in tert-alcohols.
