1.One of the role of Medical assistant is to maintain and keep patients records confidentially.If a MA places a medical record in a most accessible area to a stranger or others (may in lobby,on the desk,outside their cabin area).In these type of situation either the patient itself or others can see the records and get to know the confidential matter.This is because of the negligent act of the medical assistant to place the record in proper place.

2.The medical assistant handling the entire data of the patient if shares the information to others for monetary gains or for other reasons without proper requests or jury order is considered to be medical malpractice

3.The healthcare providers when make a mistake in patient care ,they never comeup with the truth because they are the decision makers and the chief person to decide on treatment and well aware of how to be in a safer zone during any legal issues.This makes them to win the case than the patient. This is something a loss of time and reputation for a doctor without being sued.The one thing in future is that when the patients search for a doctor when they see the records of a doctor filed for a medical lawsuit creates an inner alert that this doctor is not genuine, trustworthy and can cause them harm ,naturally making them to select another doctor.In this state the doctor will have a financial loss by decrease in the number of patients.

4.The elements of malpractice are

  • Duty:when a provider doesn't provide a quality care to the patient
  • Breach:Providing treatment which can cause harm to the patient
  • Causation:This cause the patient to experience an injury either physical or psychological due to the act.
  • Damages:This results in permanent loss due to the action

5.The best way to explain are

  • Educate about both the benefits and harms of the treatment, so that the patient can make a rationale decision.
  • Surgery completely removes the site of cancer cells usually organ and reducing the metastasis and has less relapse rate if done in early stage.Chemotherapy is also similar which destroys the cancer cells and prevents metastasis.
