Mrs. Brandmeyer, a patient on a hospital unit, is suffering from lung cancer and has surgery scheduled for the next day. She is agitated and nervous when the nursing assistant comes into her room. “Tell me again what they are going to do tomorrow,” she asks. “Am I going to be okay? Is it risky?” The nursing assistant recognizes that the patient is anxious and tries to comfort her. “Don’t worry,” the nursing assistant says. “It’s not a risky operation. You’ll be fine.” Was the nursing assistant negligent?
