Physician's contract

It is an agreement between the hospital and the physician. It is also known as physician employment agreement.

Common Clauses and provisions in a physician's- contract

A physician's contract must contain legal names of the parties or entities( they must sign in the agreement), effective date and work commencing date and the term( time period), physician's and employer's responsibilities.

Provisions such as Compensations , that include cash and benefits such as salary ( guaranteed salary for beginning years and after that based on production), life insurance, Family health insurance, dental insurance, sick pay, vacation, paid time off, short term and long term insurance and even retirement plans also mentioned in a physician's contract.

Tail coverage: The contract has to contain the clause of tail coverage in case of mal practice. It should mention clearly that who pays for that either employee or employer or shared payment.

Outside employment: Physician's contract should have the clause regarding outside employment, whether it is permitted or not permitted. If it is permitted, income should be shared or directed towards employer or not.

Access to records: 'After the contract period, whether the physician can or can't access the records of patients' is an another provision for the physician that is mentioned in the contract.

Research publication: Another clause usually found in physician's contract is the ownership of the physician's research results ( if he does) and its publication rights, usually it belongs to the employer.

Dispute costs and attorney's fees: Clause that mentions regarding dispute cost and attorney's fee ( who pays it) should be there in contract.

Clause regarding termination

This clause in the Physician's contract mentions at what circumstances and events , employer can immediately terminate a physician. Even employer can terminate a physician by giving a notice ( for a period that range from 30 to 180 days).
