Under IRS 6695(a) both the assessee and tax professionals will be liable for penalties.

The penalties for tax professionals are as follows:

  1. On failure to comply with due delivery requirements, a penalty up to $500 can be charged.
  2. When client tax is under deposited knowingly a minimum penalty of $1000 can be charged.
  3. If tax professionals prepare a tax return and the Internal revenue service finds that an amount of tax owed is due because of intentionally not following the rule and regulation related to taxation.

The penalties for the assessee are as follows:

  1. The 20 percent may be subject to accuracy and the 75 percent penalty is subject to fraud
  2. The assessee is liable to return the tax amount including interest
  3. The assessee may be banned for the next two years from claiming the refund
