Harry is a student who works part time on a regular roster in his uncle’s restaurant, together with 4 other full-time employees. Harry has always been paid according to the relevant award. For the last three weeks he has not been paid whilst working his regular shifts yet the other employees have. Harry approached his uncle who states that business is bad at the moment and he cannot afford to pay him and as he is ‘family’ he has no legal obligation to pay and thanks him for his understanding and support.

Harry approaches you and asks where does he stand legally?

According to labor laws Harry is entitled of receiving payment. Being a family member doesn't hold anything against the employer only if they have any written agreement or communication proving harry is an employee of that restaurant.
