By the end of the Civil War, after slavery was abolished, southern states established black codes, rules that sought to preserve white supremacy. Black codes sought to suppress freed slaves economically, requiring African Americans to continue to work on plantations and remain subject to racial hierarchy within the South. Black codes gave rise to a new wave of Congressional progressive republicanism and the subsequent push towards enshrining racial equality in the Constitution. Black codes, however, also set precedent for Jim Crow legislation
As the Civil War came to an end, a series of discriminatory state laws collectively known as black codes began to be passed by south states. While the laws varied in content and severity from state to state some laws actually granted people the right to marry or testify in court these codes were designed to maintain the social and economic structure of racial slavery in the absence of a "peculiar institution." White supremacy was codified by the laws by restricting the civic participation of freed people; the codes deprived them of their right;
Despite the Civil Rights Act of 1866 and the changes to the Civil War, and the fact that black codes were officially abolished, their emotions persisted and turned into a new ruling racial order. During the early 1870s, enthusiasm for reconstruction policies waned, threatened by the brutality of white supremacist groups such as the Ku Klux Klan. When Reconstruction ended in 1877, the economic and social status of freed people had seen little improvement. This laid the foundation for the Jim Crow politics of racially discriminatory discrimination that oppressed millions of African Americans.
