The Health Insurance Portability and Accountability describes how personal health information maybe used and how the client can obtain access to the information. PHI includes individually identifiable information that relates to the clients past, present or future health, treatment snd payment for health care services The act requires health care agencies to keep PHI private, provides information to the client about the legal responsibilities regarding privacy and explains the clients right with respect to PHI. The client may file a complaint if the client believes that privacy rights have been violated.

Minimum civil penalty for HIPAA violation in which individuals did not know they were violating HIPAA is $100 per violation with an annual maximum of $25, 000 for repeat violations.

Due to reasonable care and not due to wilful neglect is $1000 per violation, with an annual maximum of $100000 for repeat violation.

Health care agency should use and disclosure of PHI. The health care agency obtains PHI in the course of providing or administering health insurance benefits. Use or disclosure of PHI may be done for the following, for health care payment purposes, health care operations purposes, treatment purposes, providing information about health care services and data aggregation purposes to make health care benefits.
