Kelly v.Coca-Cola Enterprises, Inc

The agreement and disagreement of the team’s decision is based on what the final ruling that was determined. After reviewing the case, “the court of appeals affirmed the trial court’s judgment, holding that Kelley was entitled to participate in workers’ compensation benefits because he was injured while engaging in conduct with the knowledge and consent of the employer Coca-Cola. According to case appeal, “the trail court judgment should be reversed because it erred, as a matter of law, by instructing the jury to return a verdict for plaintiff where the jury found that plaintiff’s alleged injuries were proximately cause by horseplay that plaintiff instigated or voluntarily participated”.

If the event was already finished and Kelly was waiting for the bus to take him to his car it means that anything that happened at the parking lot should not be the company’s responsibility if Kelley got injured. Even though he did not agree with his co-workers and got injured we would think that the co-workers that got him injured should be responsible for the injury not the company. On the other hand, if Kelley was still on the clock and if there was evidence that he did not agree to participate with the horseplay with his co-workers than maybe he does have the right to claim worker’s compensation. Every company event has an end time and if the end time of the event was past the time Kelley was waiting for his bus ride to his car then that means he was off the clock.

Based on the case appeal, after a thorough review of the record, the court finds no error in the trial’s court’s decision not to exclude all of Dr. Staley’s testimony. While it may be true that Dr. Staley mistakenly believed Kelley was treated by a neurosurgeon for his injuries, this does not, without more, make his entire testimony so unreliable that the trial court’s decision to admit the remainder of his testimony so unreliable that the trial court’s decision to admit the remainder of his testimony amounts to an abuse of discretion. Therefore, we find the trial court did not abuse its discretion by not excluding all of Dr. Staley’s deposition testimony; Coca-Cola’s second assignment of error is overruled.
