An Orlando-based attorney, Al W. Right, went on NBC's dateline to defend his client, Nelson Serrano, who was accused of killing four people. Attorney Right claimed it was impossible for Serrano to have committed the murders, since it would have required his client to get off a flight in Atlanta's very busy airport and arrive at the La Quinta hotel five miles away in less than an hour. Then, Attorney Right seemingly made the following offer: I challenge anybody to show me--"I'll pay them a million dollars if they can do it." An enterprising law student, James T. Thrifty, decided to take up Attorney Right's challenge. Thrifty retraced Serrano's alleged route and then made a video recording of the travel. Thrifty made the trip in under 28 minutes. Then, he contacted Attorney Right to collect the money. Attorney Right refused to pay. If Thrifty sues for breach of contract _______________.

a. he will lose because there no valid contract was created due to fraud b. he will win because a unilateral contract was created when he successfully retraced Serrano's steps c. he will lose because a unilateral contract was created d. he will lose because you cannot contract to engage in an illegal contract

Answer #1

Answer (Option b) he will win because a unilateral contract was created when he successfully retraced Serrano’s steps.

Thrifty will won the case. Unilateral contract is an agreement which is one-sided. Once the acting party takes the action promised in the agreement, the other party must act because the promise is now enforceable.
