Suzan has always dreamt to be a professional model. She wishes to have a fairer
and flawless skin complexion. After looking at an advertisement on the internet,
she decided to consult Alissa, the owner of Red Beauty Saloon. Alissa
suggested Suzan to try a new beauty drink known as “Beauty 8” so that her skin
would become flawless. Actually, the drink is manufactured in Taiwan by TRZ
Health Manufacturing and imported into Malaysia by Purity Sdn Bhd. After taking
the drink for 6 months, Suzan's skin became darker and extremely painful when
exposed even to normal sunlight. Besides, she also suffered from serious health
problems due to kidney failure. A test conducted by the Ministry of Health
discovered that “Beauty 8” contained a dangerous chemical associated with liver,
kidney and heart problems.
Advise Suzan of any possible claims against Red Beauty Saloon, Purity Sdn Bhd
and TRZ Health Manufacturing under Part X of the Consumer Protection Act 1999.
After reading the case, I advised Suzan of any possible claims against Red beauty salon, purity Sdn Bhd and TRZ health manufacturing under part X of the consumer protection act 1999. As in part, if a product makes any type of damages like death or personal injury, then affected consumers may claim the producers, marketers, and suppliers. By section 10 of the protection act about a product will include safety in the context of risk if personal injury by the product.
In this case, Suzan used the Beauty 8 drink for her skin improvement, which suggested by the Red beauty saloon manufactured by TRZ in Taiwan and imported into Malaysia by Purity Sdn Bhd. After six months, Suzan's skin became darker and painful. Her skin starts exposed in natural sunlight, kidney failure, and heart problems due to dangerous chemicals associated with beauty eight drinks.
So Suzan file a case by considering the consumer protection act and the part X of the consumer protection act. The manufacturer, supplier, and marketer (Red beauty saloon) are liable to provide a claim for her health expenditures, for her future security and offers extra benefits for her as a punishment. The court may ban these manufacturers and suppliers' licenses to say these types of harmful products for customers.
