When it comes to business law or law in general who would be sued for negligence in these scenarios?

A skateboarder skating on a doctor's offices parking lot who falls and breaks a leg from a skateboarding trip?

or

A kid walking around his neighborhood and goes and plays on a construction site that is not fenced off and trips and breaks his leg in the construction site?

1) In the first case, the skateboarder would be sued for negligence although that person only got hurt by falling and breaking off a leg by tripping. It is because it is illegal to skate on private property such as in a doctor's office parking lot. So, the skateboarder is considered negligible, for his/her own actions.

2) In the second case, the owner of the construction site as well as the employer is responsible for the injury of the kid. As the construction site was not surrounded by a fence which was really important, the kid broke his leg. So, the owner of the construction site would be held negligible as he/she failed to provide appropriate working conditions at the construction working site.
