Employee rights are implied from the federal and state laws that have been established to define the various rules and regulations that govern the employer-employee relationship. Employee rights are often used to refer to the rights that are not explicitly mentioned in law but inferred from legal protections.

Employee rights are defined under various categories by the federal and state viz. union activity, i.e., the right to organize and to bargain collectively, working hours and minimum pay rights, equal compensation for men and women doing the similar work for the same employer, protection from discrimination at work on the basis of demographic characteristics, safety and health protection in the work environment, unemployment benefits, non-discriminatory hiring and promotion practices, family and medical leave and ability to complain without retaliation or the whistle-blower protection rights.

The employers are expected to mention the various rules, regulations and conditions for the above said rights and should express the same at the time of appointment and hiring of the employee. The job offer letter of the employee should include these policies and there should be sign of both the employee and the employer on the offer letter so that in case of any breach in the employment terms by any of the party, the particular condition can be made enforceable on the respective party.
