I am a defense attorney working for a wealthy client Mr. Bigbucks. Mr. Bigbucks' son, Dullard (age 17) was playing with his father's hand gun and fired several shots randomly from the Bigbuck's estate in Ottawa Hills on the evening of May 2, 2019. Around the same time as Dullard fired his father's gun, a young biology student was hit by a bullet that was the same caliber and type as was used in Mr. Bigbucks' 22 caliper hand gun. Unfortunately, the student died of complications after the surgery to remove the bullet. The coroner estimated that the impact of the bullet imparted at least 50 ft-lb of energy. Mr. Bigbucks! handgun is a Heritage Rough Rider with a 4.625" barrel. The ammunition used in Mr. Bigbucks gun was "CCI Game-point 40 gr." According to GPS, the distance from where Dullard was firing the gun and where the student was hit is 0.45 miles. Dullard has been criminally changed with manslaughter and the student's estate is suing Mr. Birbucks. for $25 million in negligence. I am the defense attorney representing both Dullard and Mr. Bigbucks. I am seeking an expert witness who can convince a jury that Bigbucks' gun was not involved in the death of the student. It is important that you know that the attorney for the student's estate has retained Dr. Douglas Oliver. He is well known for effectively challenging inaccurate testimony of expert witnesses. That is, your testimony should be technically defensible. In summary: can you demonstrate that Dullard was too far from the student for a bullet from his father's hand gun to have caused the student's injury? Mr. Bigbucks is willing to pay up to $500 per hour for consulting if you are retained. compose proof that Dullard's bullet could have (or in the alternative - could not have) caused the death of the student. Included any graphs and derivations that you consider useful.
