Question

I am taking a business law class and we have to answer two questions regarding two hypothetical examples. I missed the class examples and was hoping someone could help me with finding out the most relevant cases to the question and how to approach answering them. Thanks!

1. Queens College, recognizing that its black male students are in better physical shape than other students institutes a policy under which anyone not a black male needs to take 2 FNES classes in order to graduate while black males only need to take 1. A white male student and a female black student each separately sue the school alleging a violation of their equal protection rights. Apply our discussions and readings to analyze whether they will win. 2. Because electrical contractors are very expensive, and despite the fact that I know nothing about electricity other than it can hurt, Queens College sends me onto the roof of Temp 3 during a snowstorm to repair a broken electric cable. Trying to stop my fall off the roof I grab two electrical cables and receive third degree burns over my entire body. What compensation, if any, might I be able to obtain? Briefly explain.

Answer #1

1. FENS, Family, Nutrition and Exercise Sciences is the course offered by the queens college which prepares the students to understand and achieve their leadership role in the family as well as in the work. This course is opted by almost all students who majors in textile, hospitality etc as it could benefit them in achieving the leadership roles.

The given scenario highlights that the black students are having good physical shape than other students. By having a good posture one doesn’t have a good leading or coordinating characteristics. Hence the policy of the queen’s college to discriminate the white and black cannot be accepted. Hence the judgment will be in favor of the plaintiff.

2. The given case highlights that the management of the queens college sends a man who doesn’t have proper knowledge about the electrical components to repair the electric cable. The man get hurts.

The management is liable under the negligence of the duty of care. As an employer the management is responsible to send individual who is having a good knowledge about the electric repairing for managing the situation. Their negligence caused the hurting hence they are liable and hence to provide proper compensation
