Negligent tort is a concept of tort law that is applicable when
an entity or an individual fails to act as a reasonable person for
the duty promised earlier. Normally the negligent action results in
monetary damages or personal injury to the consumer. The consumer
can hold the producer responsible for their products when the
company products do not conform to the established standards or
violate the product standard. Negligence is based on the cause of
action. There are five elements in negligence tort including the
duty owed by the defendant, duty breach, causal action resulting in
harm, proximate cause and resulting damages.
Consumer autonomy is the character and aptitude of the consumer to
choose and purchase products rationally. Consumers have the power
to review and reject the products based on their own research.
Certain companies create customer wants, marketing practices and
advertising techniques to manipulate the consumers. This infringes
the customer autonomy. Consumers must not accept the products
blindly based on the claims of the advertiser. In most of the
cases, advertisers and marketers influence or manipulate consumers
to buy their products thereby infringing on the consumer
autonomy.
