Neal Nicely was driving on the parkway when he noticed two little 2. old ladies on the side of the road standing next to a 1956 Chevy that had the hood up. Nicely stopped and asked the ladies what was wrong. They explained that the car would not start. Nicely tinkered with the wires under the hood and instructed the ladies to try to start the car. It started and the little old ladies were quite happy. One of the ladies said "thank you sonny, we are really appreciative and will pay you $50 for your effort". Nicely, said "I accept your offer, when can I expect the money?" The little old lady said " within the week". About 10 days later, having failed to receive the $50, Nicely called the ladies on the phone to inquire as to the whereabouts of the $50 and was informed " sorry sonny, we changed our minds and we will not pay you the $50 we promised". Nicely was quite disturbed and sued the little old ladies. Will Nicely prevail? Explain the relevant concepts.

In this case it is quite clear that there is a contract between Neal and the two old ladies who were having issues in their car. Neal actually took care of the situation based on which she was offered an amount by the ladies and this was a verbal contract where the consideration is the work or services provided by Neal. So, if we look at the aspects we will clearly see that there is an offer, an acceptance and the consideration as ell which makes it enforceable and legally binding too.

The action of the two ladies is creating a breach of contract because they are not agreeing to the terms agreed during the contract and hence based on this Nicely can actually file a lawsuit but prevailing the same or establishing the contract and it's validity will be difficult because in case of oral contracts, the witness is an important aspect which is not present here and in addition there is no such evidence to prove the transaction or contract as well.
