Sally posts a letter on the 5th Of March offering to sell a painting to Michael. Michael receives the letter on the 8th of March and accepts the offer by posting his reply on the same day. On the 10th March, Michael changes his mind and send Sally an email telling her he is not interested in buying the painting and asks Sally to ignore the letter of the 8th when it arrives.
Having read Michael's email, Sally sold the painting to Carla for $500 on credit, with full payment to be made on the 28th of March. On the 20th of March, Sally hears Carla is in financial trouble and may not be able to pay for the painting on the due date. On the 20th, as soon as she hears this, she writes to Carla stating that if she receives immediate payment, she will give her a discount of $50. Carla writes back to Sally thanking her for her letter and encloses a cheque for $450. Carla receives a letter from Sally containing a receipt stamped 'in full settlement of the account'.
Advise Carla as to whether she may still be held liable to the unpaid amount $50.
Would there still have been a contract to sell the painting if Sally and Carla were relatives?
