In this contract, the value of the paint exceeded the value of the labor. By mistake, Pats workers paint Frank Farmers neighbor, Marla Menaces barn. Marla, knows that Pats workers are making a mistake, but says nothing because she needs her barn painted too. She lets them finish the job. After the job is finished, Marla refuses to pay Pat for the job. Frank Farmer entered into a legally enforceable contract to sell Bert Buyer all the wheat he needs for the next year. After the price of wheat increases dramatically, Frank refuses to ship any more wheat unless Bert agrees to pay $30 more per shipment of wheat. Bert agrees to this reasonable modification. The next shipment arrives, Bert accepts the shipment, but refuses to pay the additional $30, stating the modification is not enforceable since it is not supported by consideration. PRIMARY POST: Discuss Question 1 1) Pat sues Marla to recover for the painting her barn. Would a court require Marla to pay Pat for the painting, even though she did not enter into a contract with him?
