A homeless man enters the hospital with chronic gangrene, osteomyelitis, and diabetes. After the patient intake, the physicians determine that he also had a psychiatric condition. He refuses treatment with medication or to submit to a psychiatric evaluation. He requests simply to be fed, given his insulin, and given a bed for the night. His physicians try to persuade him to accept intravenous antibiotics, but he refuses. The physicians must make a decision: send him back to the street, or seek a court order declaring the man incapable of making decisions for himself, essentially forcing him into the physicians' care. Would it be legal for the hospital staff to restrain the man? Based on his condition, would it be ethical and legal to discharge him?
