The concept of copyright have significance in the Context of contemporary scientific, economic, social, political and legal environment in the entire world. technology innovations e.g. computers, audio recording, video recording, reprography, cable television, satellite broadcasting and most recently Internet have posed challenges to copyright laws from time to time and forced the nations to amend their laws. The copyright law not only protects the rights of the copyright owner and neighboring rights but also deals with the subject of public interest and tries to strike a balance between the two in this digital environment.

OBJECTIVES OF COPYRIGHT LAW The primary objective of copyright is not to reward the labour of authors but to useful arts. To this end, copyright assures authors the right to their original expression but encourages others to build freely upon the ideas and information conveyed by a work. The objectives of copyright law are mainly twofold.

Who can own the copyright?

The creator of the work owns the copyright as he/she creates the work. But it might not be possible for the creator to exploit the work all by himself. Therefore, the creator may assign such rights to persons who may commercially exploit the work. Example – The author of a novel may not want to get into the hassle of printing and distributing the books. So he assigns the copyright to the publishing house for such purpose. Similarly, a computer programmer may not have the resources to package, advertise and sell the software. So he may assign the copyright to a company which does the same for him.

Several exclusive rights typically attach to the holder of a copyright:

  • to produce copies or reproductions of the work and to sell those copies (including, typically, electronic copies)

  • to import or export the work

  • to create derivative work (works that adapt the original work)

  • to perform or display the work publicly

  • to sell or cede these rights to others

  • to transmit or display by radio or video.

1. A work becomes copyrighted when it is fixed in a tangible medium of expression. There are categories of work that fall under this definition:

4. Dramatic works, including the accompanying music
5. Pantomimes and choreographic works
6. Pictorial, graphic and sculptural works
7. Motion pictures and other audiovisual works

1 Works not fixed in a tangible form of expression (ex. something said but not recorded)

4 Works found in the public domain
5 Works that are strictly informational and contain no authorship

Concept of fair use under US copyright law

Fair use is a legal doctrine in the United States. It permits limited use of copyrighted material without acquiring permission from the legal holders. In general term Fair Use is if you are not using the copyrighted material for any monetary benefit.

Conclusion – Thus we can observe from above discussion that copyrigt law promotes ethical environment in economy among the peoples of different creativity.
