  • Under the new 2018 law, taxpayer can  defer gain on exchange if provided only for real estate properties and not for personal or intangible properties.
  • Defer gain on exchange of personal or intangible property is allowed if exchange have been done before 31st December 2017.
  • Real estate property used for business, trading or investment purpose are qualified as like- kind exchange.
  • The asset being sold must be a business property and cannot be used as personal residence.
  • ​​​​​​​Asset being purchased with the proceeds of sale must be similar to the asset sold. Property used for personal use or intangible property do not qualify for like-kind exchanges.

Hence, the statement which is TRUE in regard to Archies exchange of business property is:
