1.It is permissible for an employer to ask for physical exam from a job applicant. This is mainly required to prevent any medical issues arising out of specific job ,in some cases to prevent aggression of disease,or simply to avoid transmission of disease in accordance with the work environment .It is legal as per the government.

For example :

A medical professional is always screened off physical examination (HIV,HCV,HbsAg)to prevent transmission to patient and vice versa (immunization, preventive techniques )

2.The employees deserves no rights to ask for any physical or mental disability of a job seeker and considered illegal by American with Disability Act of 1990.But in certain cases the employees are forced to ask question regarding disability if it is going to give a poor performance or inability of the job seeker to do a job

For example :

When a physical trainer is hired the recruiter are supposed to ask for any musculoskeletal problems ,cardiopulmonary problems which can interrupt the efficient delivery of work from them.

  • Do you have any complaints of diabetes, heart failure,COPD (which all can be aggregated in case of physical training )
