Legal Protection for individuals that act as 'whistleblowers' for an organisation or a company is necessary to safe guard the said individual's saftey and interests.
The Whistleblower Protection Act 1989 was established into federal law in the United States . The law states that Whistleblowers are protected from any retaliation for disclosure of any information that act as evidences of any illegal activity such as fraud , waste of funds , corruption etc.
Whistleblowers are essential to keep check on the activites done within a corporation , especially when the said corporation operates in large scale with multiple departments and branches all around the world. They identify any fraudulent activity that happens within the organisational chain and report it to the right authorities. Whistleblowers are necessary to point out activities of corruption in the organisation and to point out instances of "window dressing" in the books of accounts of the company.
A whistleblower in the US could get 15%-30% of the penalty the government collects from the company if the lawsuit wins the case . An example would be, Dinesh Thakur , former Ranbaxy employee was awarded $ 47 million as reward on the basis of False Claims Act after the US Justice Department collected $500 million as penalty from Ranbaxy.
So in conclusion, the role of a Whistleblower is significant to help maintain better organisational functionality and to curb any illegal activity which happens within the organisation that could go easily goes unnoticed. In order to protect the interest and saftey of such individuals that strengthen the stance of justice in the organisation , legal protection is required.
