How does consumer Protection Authority (CPA) bring action ? How is it different than FTC in bringing action?
CPA or the Consumer Protection Authority with their new Act of
2019 has brought in more grounds for the consumers to file
complaint or raise disputes. These are resolved by increasing
pecuniary jurisdiction by commissions, attaching mediation cells,
increasing members of commissions and imposing higher penalties.
They have empowered consumers who can not merely raise disputes
with the sellers or manufacturers but also the endorsers of such
products. The Central Consumer Protection Authority can pass orders
to recall products which are defective and consumers can demand
refunds for faulty services as well. They can impose penalties and
inquire into violations of rights of the consumers along with many
other activities. FTC on other hand enforces antitrust laws and
protects consumers against predation. They seek to eliminate anti
competitive business practices. They are an independent body and
after tracking unfair practices they consult their legal partners
to solve the issues. But CPA is not dealing with anti trust
practices separately. Their aim is to protect the consumer
holistically and can take direct action once their commission has
completed inquiries.
