If mediation is not successful the parties must resort to litigation, and anything said during mediation can be used as evidence at trial. False.


If mediation fails the parties must resort to litigation but they can't produce anything in the court that was discussed during mediation. The matter discussed during mediation can not be used as evidence at trial because it remains private and confidential between the parties.
