Yes, the source patient have to give legal consent to have the test done for HIV because it's a case of confidentiality and maintaining privacy . Not only HIV any confidential information regarding the patient should be kept in close confidentiality and maintained in the reports and should be only reported to the patient and his or her family members after taking consent from the patients .
