Describe the requirements for Workers’ Compensation eligibility? In order for an employee to receive Workers’ Compensation benefits, what criteria must the injury meet? What is the purpose for such restrictions?

Requirements for worker's Compensation Eligibility:

  • One must be an employee in an organization.
  • The Employee should get worker's compensation insurance from an employer.
  • Employee has to report the injury or illness within the deadlines to receive the compensation.

Criteria for injury to meet the worker's compensation insurance:

  • The injury must happen during work and it should be work-related. e.g straining of muscles, falling.
  • Injuries that happen due to hazardous material or chemicals. e.g exposure to toxic fumes.
  • Mental illness that happens due to work.

Purpose for such restrictions:

Compensation benefit is not eligible for part-time workers. Independent contractor, consultant are not eligible for worker's compensation. Injury outside of the work will not come under worker's compensation benefits.
