20 21 Capacity Suppose my 16 year old daughter has saved her money and makes a downpayment on a 2010 Chevy Impala. She pays $1,000 down and the dealer finances $4,000. Problem is, she's never really driven before, so after she drives it off the lot, she has a wreck and totals it. Can she take the car (or what's left of it) back to the dealer and get her money back? No, she cannot take the car back to dealer because it is not in the condition that she received it in. Hence, she would still need to pay the $4,000 and would not receive money back. If she wrote a hot check she would still be responsible for the money she owed to the store because even though food is a necessity a check is not a contract.
