Exceptions to FSIA:

Commercial activity exceptions are the exceptions to the rule. The following are the exceptions:

• When a commercial activity has been carried out by a foreign state in the United States. Then the plaintiff’s claim can be valid.
• When the plaintiff’s claim is such that an act has been performed by the foreign state outside the United States in connection with commercial activity outside the United States & that has a direct impact on United States.
• The basis of plaintiff’s claim is such that an act by foreign state is performed in United States in connection with commercial activity outside the United States.

Example of such commercial activity can be the operation of a fee based transporting system that can be a commercial activity while imposing fines for parking tickets can be a public act even if the former act was done with the motive of rendering public service & the latter was for the purpose of raising revenue.
