Answer #1

A trademark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of the goods of one party from those of others.

No, a trademark does not need registration because it has common law trademark protection associated with it.

The advantages of registration are:

1. The organization has exclusive rights of using the same in products or services.

2. Trademark after registration is considered as an unique intangible property.

3. It can be licensed and as well as transferred.

4. Can be used in foreign countries as well for protection of the brand.

The filing fee may range from $225 to $400 per class of goods and services and this price varies based in the type of application submitted.

The two possible trademark formats are standard character format andastylized or design format.
