1. That is no and yes question for even with all the legislation, the FCAP has been criticized for lacking any real teeth because of its formal recognition of facilitation payment as long as they can provide secure performance of a routine governmental action. however this has not undermined the effectiveness of the FCPA. the DOJ and SEC take all infraction and violation very seriously for they enforce criminal penalties which is subject to heave fines per violation and imprisonment.

2. The commission amended guidelines after major frauds and scandals that were occurring herein the U.S and abroad. the FSGO provided enhanced incentives for organization to create or improve meaningful compliance and ethics programs, report violations, cooperate in criminal investigation, discipline responsible employees, and take steps needed to prevent and detect criminal conduct by their employees and agents.
