Just cause is the reasonable and lawful evaluation of a person's action. It can be said that in Incompetence an employer may fire an employee if that employee lacks the capacity to meet the required standard or when the employee is negligent. An employer can not rely upon the incompetence as justification to terminate an employee may not occur. For this, the employer needs to prove gross incompetence. Employees can't be terminated in the first place and are given a few warnings before they are being terminated. Employers also need strong points to terminate an employee such as long term lower attentiveness and lower productivity than that of other employees.
