The literal meaning of the word prejudice is “preconceived opinion that is not based on reason or actual experience”. We may also define prejudice as unreasonable and unfair feelings or opinions that may be specially formed without enough knowledge or thought. A person can be called as prejudiced when he or she has formed and developed an attitude towards particular social/professional/other groups of people before actually going through substantial information on the basis of which an informed and knowledgeable opinion could be formed. Negative prejudice means that the bearer of such an attitude is hostile towards the other group. A person with prejudiced opinion may target other people and groups on the basis of ethnicity, religion, social class, language, physical abilities, gender, sexual orientation and color of skin, among other aspects. Prejudice takes many different forms and discrimination is one of them. Discrimination is said to occur when people are unfairly treated because they do not belong to the dominant group of society. For instance, an employer may discriminate against an employee because of his prejudiced opinion regarding the employee’s ethical background.

“Prejudice” in Legal Terms

In legal terms, prejudice can be defined as a bias, pre-judgment or preconceived opinion. It may be defined as leaning towards one side of a cause for a reason that is not in conviction to justice. Judges cannot be prejudice and if they are, they may be disqualified from a case. This is because their prejudice or bias will influence the final outcome or decision in the wrong way.

The “without prejudice” definition of a lawsuit means that all the privileges and rights of the parties or individual involved with the case have not been altered in any way. In these cases, the judges cannot reach any decision about the controversy that is brought to their notice, because there are no merits for it. In this case, the plaintiff can file the case in any other court. In case a case is dismissed “with prejudice”, it means that the plaintiff does not has the right to re-file the case in any other court (res-judicata).
