On October 31, 2011 a large group of XXX university students marched in a demonstration march took place in front of Gerbino's grading policy. The said with the assistance of sound track. All demonstrators were arrested for disorderly conduct. Will a prosecution succeed? could gerbino have successfully obtained an injunction prohibiting the march? why? Why not?

Illinois public demonstration law prohibits any march, assembly, meeting, parade or gathering, in any location, municipal area unless it is with the local permission is considered unlawful. It can lead to arrests and subsequent legal prosecution.

A prior injunction could have taken place if the teacher was aware of the march planned. He could have put a written request to ban the march.
