After reading the articles on eminent domain (and others you find), write an essay on the pros and cons of this legal tool. How would you like to live for many years in a cottage on the shore, only to have the town take your land to give to a private group so they can get more tax revenue?
Homework Answers
Eminent domain is the law which allows government to take land by giving fair compensation from public for the development process of the city.It allows government to take away the property also from the people who refuses to give their property.
Pros:
It allows government to use the land for development process.
It limits the chances of asking government for more that the reasonable compensation.
It provide a way to solve the problem of stoping development.
Cons:
It allows government to disturb the live's of the people by taking away the land even they refused. It is nothing devaluation of rights of the people and make them feel unsatisfied with the government.
It allows government to misuse the law. In some cases government takeaway the properties of the people just to get more taxes.
They may not give fair compensation to the people.
The value of the property can be calculated with the market value,but the value of the livelihood of the people can't not be calculated.
If I face the situation I would accept the fair compensation and find other place to live. Because there is no other way to refuse the eminent domain. There are lot of people who loss their homes and businesses just with the reason government wants to take the land to get more taxes in future.
