Question 4:Review Julie Hilden’s arguments for why some “exceptions” should be made in cases of prosecuting sexting crimes under current child pornography laws. What does she mean by the “Romeo and Juliet” exception and by the “age-specific” exception? Are these exceptions plausible in the kinds of sexting cases that we examined? Describe some of the challenges posed by the age-specific exception. For example, what would happen if a middle-aged man received an unsolicited nude photo from a teenage girl on his cell phone? Should he be prosecuted for possessing a pornographic image of a minor? Should the teenage girl who sent this photo to him be prosecuted for transmitting the image? Defend your answers.

" The Romeo and Juliet exception that Hilden suggests that if two teens that are close in age such as a 16 year old girl and her 18 year old boyfriend exchange nudes then neither should be convicted of extreme crimes such as possession of child pornography, I think this is reasonable and seems like a good baseline to work off of in order to further update these laws. As far as I can tell the “same age exception” isn’t that different from the Romeo and Juliet law she mentioned earlier, if two teens of the same age range send nudes to each other and both parties consent this exception would apply, and neither would have legal repercussions. Now what would happen if a female sent an unsolicited nude to and older man? I think if the man reports it, there should be no repercussions for him, the girl should be punished I think this should be taken seriously and the punishment should be dealt with. If a young man sends a nude photo to his teacher hoping to ruin her reputation and get her fired, I would expect the boy to be punished severely. In both these examples the teens decided to send these images and they should be able to handle the consequences."

Hilden hope that police at lease can authorities the different between a real sexting crime and “ugly immaturity.” I think it is reasonable, because two children really cannot tell the truths about sex. We should teach them, bring them back to the right view about sex, give them a chance, but not just call them criminal. A nude photo from a teenage to a middle-aged man maybe induce him to make mistake. I think both of them should be prosecuted, but the prime should based on the content and course.
