Suppose that Iris sends Mike her detailed plan for an EISP along with a draft of a fully revised Enterprise IT Policy, with all of the necessary changes in the supporting policies. Suppose further that, during the Enterprise Policy Review Committee meeting, Charlie submits the revised EISP exactly as Iris has revised it but does not include any reference to the work that Iris did. In fact, Charlie presents the enhanced EISP as his own work.

  1. Has Charlie broken any laws in representing Iris’ policy work as his own?
  2. Has Charlie committed an ethical lapse in doing so, or is he just being inconsiderate?

Answer #1

Answer 1=If we look at the given situation, the work of Iris was copied by Charlie and it was presented in Enterprise Policy Review Committee meeting without having any reference or source mentioned for the work done by Iris. This is a clear violation of intellectual property rights.

The intellectual property right is the legal protection that is provided to the creator of the intellectual property to protect his or her work of creativity against any kind of unauthorized use or using the work without taking permission from the actual writer or creator of the work.

Thus Charlie is accused of violating the Intellectual Property Rights of Iris. If he wanted to use the work of Iris in his report to the presentation, he must ask the Iris for the same or quote hi references in the presented report. As this was not done, thus this action is a clear violation of the law.

Answer 2-There is obviously an ethical lapse as Charlie presented the work done by Iris as his own and this is totally against the norms of ethical standards. The ethical framework indicates that on the first account one should not use or copy the work done by others and if somehow it has to be utilized, then either the permission must be sought from the creator of the work or some sort of reference or acknowledgment must be provided
