John is a home builder and contractor, and builds large subdivisions. He is suing one of his suppliers for breach of contract. The contract required the supplier to deliver wood beams three times a week for use in the home construction. The supplier fully delivered for one month, but then stopped delivery. The complaint and the answer have been filed and they are in the middle of discovery. John's attorney has three remaining areas he would like to investigate. These are (1) to review a copy of the suppliers shipping records because he believes the supplier was selling the wood beams to a competitor for more money; (2) preserve the testimony of the owner of a lumber company that provides the wood to the supplier (the owner of the lumber company will not be available for trial); and (3) get the supplier to admit before trial that he stopped shipping the wood beams to John.

The discovery methods we would use to obtain this information and they would work as below:

  • Request for information: This is the legal process that plaintiff can raise the information request to the defendant and defendant is required to provide the requested information to court against the case. In this process, the supplier will be required to submit his information of customer list along with his selling figures and supplier also required to provide the purchase list along with buying figures.
  • Information from competitor: Plaintiff will directly reach to customer who buys the beam from this supplier and he can get the required information against the legal lawsuit from that customer. This information can be cross checked with the information provided by the supplier to court.   
  • Information from buyers: Plaintiff will directly reach to supplier who supplies the raw material for beam to the supplier and we can get the required information from that supplier against the legal lawsuit. This information can be cross checked with the information provided by the supplier to court.

The court will support us in getting this information as per legal lawsuit and the parties i.e. vendor, customer and supplier will be providing this information a per court request process.
