What factors may be used to decide whether a victim is reasonably fearful of harm in the threatened use of force?
One of the factors that would help one understand that a victim is reasonably fearful is when the victim stops doing whatever they do and acts as per the instruction of the officers who use force. Second factor is when the victim doesn’t take any weapons to attack the officers and finally when the victim doesn’t take any efforts to escape from the officers using force. Officers should keenly look for these factors in order to treat the victim as per the law because misunderstanding the behaviors of the victim would force the officer to attack the victim.
