Sally enters into a contract with John to purchase John’s 2015 Volvo for $18,000. On the day that the contract is to be performed Sally tenders the $18,000 but John refuses to deliver the Volvo. Sally sues John for breach of contract. Sally locates a Volvo identical to John’s. Sally purchases the identical Volvo for the price of #20,000. In addition the automobile was located 150 miles from where Sally and John resided. Sally pays Bill, a classmate, $150 to go to “pick up and deliver” the Volvo. Discuss the amount of damages, if any, that Sally can recover. Identify the legal classification for each “type” of damage Sally receives. Would the amount of damages change if Sally went herself to pick up the Volvo?
In the given case, Sally can recover two damages from John due to a breach of contract.
First, the difference in the amount between the Volvo bought and the price of the Volvo which was agreed by both. Thus the first damage amount is $20000-$18000=$2000
Second, the amount which was paid by Sally to her friend to pick the Volvo costing her $150.
Therefore in the given case, total damage of $2150 can be charged by Sally from John due to a breach of contract.
Even if Sally goes o pick Volvo by herself, even then she can ask for the compensation of the travelling cost incurred in receiving the olvo from its location
