According to HIPAA i.e., The Health Insurance Portability and Accountability Act of 1996, medical students and trainees (only during the course of their training) are allowed to access the patient files. But if you are not a trainee or a student, then only after the patient's permission you can access those files. in special cases of emergency situations like life or death situations or in conditions where the patient is not conscious to tell about his/her medical history in surgery or operation.
