Yes organ trade be legalized. There is a worldwide shortage of organs available for transplantation, yet commercial trade in human organs is illegal in all countries except Iran. Despite these prohibitions, organ trafficking and transplant tourism remain widespread. The data on the extent of the black market trade in organs is difficult to obtain.

Iran is the only nation that allows organs to be bought and sold for money. Due to lack of infrastructure to maintain an efficient organ transplant system in the early 80's, Iran legalized living non-related donation (LNRD) of kidneys in 1988.The Charity Association for the Support of Kidney Patients (CASKP) and the Charity Foundation for Special Diseases (CFSD) control the trade of organs, with the support of the government. These nonprofit organizations match donors to recipients, setting up tests to ensure compatibilityDonors receive tax credit compensation from the government, free health care insurance, and often direct payment from the recipient with the average donor being paid $1,200.Some donors are also offered employment opportunities. Charity organizations support recipients that cannot afford the cost of the organ. Organ donors may be living or may have died of brain death or circulatory death. Most deceased donors are those who have been pronounced brain dead. Brain dead means the cessation of brain function, typically after receiving an injury (either traumatic or pathological) to the brain, or otherwise cutting off blood circulation to the brain (drowning, suffocation, etc.). Breathing is maintained via artificial sources, which, in turn, maintains heartbeat. Once brain death has been declared the person can be considered for organ donation. Criteria for brain death vary. Because less than 3% of all deaths in the U.S. are the result of brain death, the overwhelming majority of deaths are ineligible for organ donation, resulting in severe shortages.
