. The late Supreme Court Justice Antonin Scalia argued that because courts are not elected representative bodies, they have no business determining certain cr4itical social issues. He wrote:

Judges are selected precisely for their skill as lawyers; whether they reflect the policy views of a particular constituency is not (or should not be) relevant. Not surprisingly then, the Federal Judiciary is hardly a cross-section of America. Take, for example, this Court, which consists of only nine men and women, all of them successful lawyers who studied at Harvard or Yale Law School. Four if the nine are natives of New York City. Eight of them grew up in east-and west-coast States. Only one hails from the vast expanse in-between. Not a single South-westerner or even, to tell the truth, a genuine Westerner (California does not count.) Not a single evangelical Christian (a group that comprises about one quarter of Americans), or even a Protestant of any denomination. To allow [an important social issue] to be considered and resolved by a select, patrician, highly unrepresentative panel of nine is to violate a principle even more fundamental than no taxation without representation: no social transformation without representation.

The explanation and comparison is good, and there is a base for this comparison. Still, there are many communities, areas and people who do not have their representations in many government bodies. Even in 21st century, in 2020 also, there are many minorities who have struggles to raise their voice, the developed communities or people are not listening their voices.

Perhaps, legal system is the only system which still working on fact and fair based around the world. Here people gets higher respect after teachers because of their dedication, fairness, transparent and their commitment and talent. One of the highest reputation job it is, hence, it requires the people who really have the abilities to distinguish:

  • what is right and what is wrong
  • what is good and what is bad
  • treatment of all as equal
  • no discrimination and
  • fairness and transparent

A common man can not follow all these accurately. The one who can follows only becomes a lawyer or judge. Any one can become a judge or lawyer, for that he or she needs to possess the qualifications as well as skills and must carries the interest to become a lawyer or judge.

I can agree to the statement, the social transformation can not be happen without representation but also can not say that, if there is a voice or representation, then social transformation is there are going to be there.

One should thrive with hard work and have a goal, work hard to achieve the goal. Then these many discrimination are not going to be there.
