Ubers Flexible Jobs Drive Rapid Expansion

The fastest-growing start-up on record operates in hundreds of cities around the world but has just a few thousand full-time employees. That company is Uber, the ride-sharing service. Most of its transportation work is carried out not by employees on the payroll but by more than a million individuals who have signed up to give Uber rides as independent contractors.

The decision to use this type of flexible work arrangement means Uber has chosen to limit the degree to which it controls the way work is done. Uber drivers use their own cars and decide when they want to work. They pay about 20% of each fare to Uber and control how they use the rest to pay the cost of maintaining and operating their vehicles, as well as the taxes due on their driving income. Anything above those expenses is theirs to keep for fun money—or if they work long hours, as their main source of income.

Still, Uber does retain control over many aspects of these jobs and the services provided. Uber uses a computer system to set the price of a ride, which varies according to demand. Drivers can choose to work more during high-demand periods, when prices are higher, but if they want to work when demand is low, they have to accept the lower prices. Drivers also must pass a background check, keep passenger ratings above a set level, and use Uber’s smartphone app. If they violate these and other terms—for example, engaging in risky driving behavior or driving a vehicle they didn’t register with Uber—the company can deactivate their driver status.

To maintain long-term success with this work design, Uber will have to overcome some challenges of the independent-contractor model. Employees receive certain protections and benefits, such as extra pay for overtime, insurance benefits, and reimbursement for their mileage. Some employees have sued to be classified as employees and receive these benefits. The courts have so far been divided on the status of Uber’s drivers, meaning that how to stay on the right side of the law remains an open question. In addition, even if the courts come to accept these work arrangements with independent contractors, the fact remains that drivers who are full-time employees generally would receive a benefits package, including paid holidays and health insurance. Other companies could compete for the best drivers this way, so Uber has to ensure that its jobs continue to be motivating enough to attract and keep good drivers.
