In terms of legal implications the Malaysian law will require that the business of travel agency take up one of the following forms – sole proprietorship, partnership, limited liability partnership (LLP), private limited company (also known as Sendirian Berhad or Sdn Bhd), or public limited company (also known as Berhad).

For starting a travel agency an application needs to be sent to the Companies Commission of Malaysia (CCM). The CCM will then check the availability of the proposed business entity’s name. After this your company secretary can start doing the formalities with CCM.

In terms of agreements all agreements will be governed by Malaysia’s Contract Act 1950. The main elements of Malaysia’s Contract Act 1950 are offer, acceptance, consideration, intention to create legal relations, capacity to contract, and free consent.
