No, it is not unethical when attorneys with name recognition charge a higher fee in comparison to attorneys who lack name recognition but have the same amount of experience. This is because the attorneys who are charging the higher fees are merely capitalizing on the goodwill that they enjoy or command. This goodwill has been built after years of hard work and providing excellent legal services to clients. It should, however, be noted that the higher fee should be reasonable and should not be overly excessive. If an attorney does charge a reasonable premium for name recognition and goodwill then it will be considered ethical. However, when an attorney charges an excessive or unreasonable amount of premium for name recognition and goodwill then it will be unethical. In such a situation the concerned attorney is violating the Lawyer’s Code of Professional Responsibility. Different states in US have their own code of professional responsibility for lawyers and attorneys and each of them states that an attorney should charge reasonable fees for his services. For instance the New York Lawyer’s Code of Professional Responsibility states that a lawyer or an attorney should not charge more than a reasonable fee else it will be detrimental to the interest of the client as well as that of the attorney in the long run.
