chapter 4723-13 Delegation of nursing tasks .

DELEGATION means the transfer of responsibilty for the performance of a selected nursing task from a liscenced nurse authorized to perform the task to an individual who does not otherwise have the authority to perform the task..

DELEGATING NURSE means the nurse who delegates a nursing task or assumes responsibility for individuals who are recieving delegated nursing care.

A nursing task may be delegated to an unlicenced person only by a licenced nurse.

Nothing in this chapter shall prohibit an unlicenced person from assisting an individual who can safely self direct his /her own care , including , helping the individual with self adminstration of medication in a facility where the substantial purpose of setting is other than the provision of health care.   

Remind an individual when to take medication and observe to ensure that individual follows the directions on the container.

Assist the person by taking meications from the storage place and open the container ,if the individual is physicaly unable to open

Assist upon request by or with the consent of a physicaly impaired but mentally alert individual, in removing oral or topical medication from the container and in taking or applying the medications..

Unlicenced assisting person cannot administer medication to an individual whether orally,by injection, or by any other route.

No person to whom a nursing task is delegated shalll delegate the nursing task to any other person.

Unlicenced person cant perform a delegated nursing task on any individual other than the individual specified by the delegating nurse.

A licenced practical nurse may delegate to an unlicenced person only at the direction of the registered nurse. unlicenced person can administrate only the following medications.

over the counter eye drops, ear drop, suppository medication, foot soak medications,enemas,topical medications to intact skin for barrier or improoving skin conditions.

Delegating nurse shall determine following things prior to degluting task to unlicenced person

a. Task is within the scope of practise of degluting nurse as set forth in section 4723.01

b.Task is within the knowledge ,skill,abiliity of the nurse delegating the nursing ttask

c. Task is within the training ,ability ,and skill of unlicenced person

d. Appropriate resourse and support arte available for performance of task

e. Appropriate supervision by a licenced nurse

f. Task requires no judjment based on nursing knowledge.

g. The result of tasks are predictable

h. No complex observation or critical decision be made with respect to task

i. Consequence of performing the nursing task improperly are minimal and not life threatening .
