1.1.The phlebotomist or the technician who collects the sample is not liable because he has done things as per the standard and protocol by first comforting and reassuring the patient,making her to sit and diverting her through conversation yet failed because of patients severe anxiety

2.The patient is liable here because a patient who comes to produce a sample for testing should get prepared physically and psychologically atleast to the most basic. Also in case of severe anxiety a relative or a partner to support can be accompanied the patient.

3.Emma is partly responsible for her fault due to fear.She could have probably receive more support during the procedure.

4.This type of injury can be greatly prevented by making the patient lie down or in supine position while collecting the sample to prevent fall and injury.
